Legal Process Explained (Section 47 & 48)
When NOC Is Required
An NOC becomes mandatory when a vehicle registered in one State is kept in another State for
over 12 months and requires assignment of a new registration mark. Re-registration must be
supported by an NOC or proof that the NOC application has been submitted.

Accepted Proofs in Place of NOC
If the NOC has not been received, the Act allows alternatives such as the NOC application
receipt, postal acknowledgement, or a declaration confirming that no refusal has been issued
by the original RTO.

Financier’s Approval (Hypothecated Vehicles)
For vehicles under loan, hire-purchase, or lease, a financier NOC is compulsory. The financier
must issue or refuse the NOC within 7 days—if they do not respond, the NOC is legally treated as
automatically granted.

Verification by Registering Authority
After receiving the application and NOC (or acceptable proof), the new RTO verifies all details,
checks records, and ensures the vehicle’s legal status before approving the request.

New Registration Mark Assignment
Once cleared, the RTO assigns a new registration mark, updates the RC, and officially
communicates the change to the original registering authority for record synchronization.

Common questions about vehicle ownership transfer under Section 50 of the Motor Vehicles Act
An NOC is a No Objection Certificate issued by the registering authority when a vehicle is being moved or re-registered in another State. (Ref: Section 48, MV Act)
You need an NOC when the vehicle is kept in another State for more than 12 months and you apply for assignment of a new registration mark. (As per Section 47(1) & 47(1)(i))
The registering authority where the vehicle is originally registered issues the NOC. (See Section 48)
If you apply, receive a receipt, and the RTO does not communicate refusal within the prescribed period, you can use the receipt or postal acknowledgement as proof. (Ref: Section 47(1)(ii))
